Terms of Use

1. Agreement
These Terms of Use ("Terms") are issued by EL Industries Pty Ltd (ABN 66 655 026 823) ("we", "us", "our"), the operator of PubWatch UK, the website at pubwatchuk.co.uk (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service. Nothing in these Terms affects your statutory rights as a consumer.
2. The Service
PubWatch UK publishes pricing information for food and drinks at pubs and other licensed premises across the United Kingdom, together with comparisons and rankings built from that information. The Service is provided free of charge for personal use, to help patrons compare prices and decide where to go. It is general information only.
3. Prices Are a Guide Only
Prices are a guide only. Venues set and change their own prices at any time and without notice, and a listed price may be out of date, incomplete or wrong by the time you visit. Always confirm the current price with the venue before ordering or making a decision based on a listed price. Specials and happy hours are offered on the venue's own conditions, may be limited or withdrawn, and are not guaranteed to be available. PubWatch UK is not affiliated with any listed venue, and a listing does not imply the venue's endorsement of, or involvement with, the Service.
4. Age and Drinking Responsibly
The Service provides pricing information relating to licensed premises and is intended for persons aged 18 or over. The Service does not sell alcohol and cannot be used to purchase alcohol.
Prices, comparisons, specials and crawl plans are published so you can see what a venue charges. They are not an encouragement to drink, and they are not a recommendation about how much to drink. Alcohol affects people differently, and drinking to excess carries real health and safety risks. Please drink responsibly, know your limits, and never drive after drinking.

5. Submissions and Ratings
You may submit a price observation or rate a venue. By making a submission you confirm that it reflects your own genuine observation. You must not submit information you know to be false or misleading, personal information about any person, or content that is offensive, unlawful or promotional. Submissions are anonymous and, if accepted, become part of the public pricing record: you grant us a perpetual, irrevocable, royalty-free licence to publish, adapt and use them as part of the Service, without attribution or compensation. Submissions are reviewed before publication, and we may accept, reject or remove any submission at any time at our discretion, as described in the Privacy Policy. 6. Acceptable Use
You must not: (a) interfere with or disrupt the Service or the systems that provide it; (b) access the Service by automated means, or harvest, scrape or bulk-extract its content or data; (c) use the submission or rating channels to spam, to distort the pricing record, or to promote a venue or business; (d) attempt to gain unauthorised access to any part of the Service; or (e) use the Service for any unlawful purpose. We may limit, suspend or block access to protect the Service or other users.
7. Intellectual Property
The Service and everything comprising it, including its design, layout, text, graphics, logos, software and the pricing record, being the compilation of pricing information we have assembled through substantial investment, skill and effort, are owned by or licensed to us and are protected by copyright, database right and other intellectual property laws. Nothing in these Terms transfers any intellectual property right to you.
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Service for personal, non-commercial purposes only. You must not, without our prior written consent: (a) copy, reproduce, republish, redistribute, sell, license, display, frame or otherwise make available any part of the Service or the pricing record; (b) use any part of the Service or the pricing record for a commercial purpose, including to build, train or improve any product, service, dataset or machine learning model; (c) create a derivative work from, or a product or service that competes with, the Service; (d) remove or alter any copyright, database right or other proprietary notice; or (e) use our name, logo or branding. Venue names appear only to identify venues and remain the property of their owners; their use does not imply any affiliation or endorsement. All rights not expressly granted are reserved, and we may seek injunctive or other equitable relief, in addition to any other remedy, for a breach of this section.
8. Third-Party Services
The Service includes content supplied by third parties, including map data and imagery, and may link to third-party websites and applications. Those services are governed by their own terms and policies, which we do not control and for which we are not responsible.
9. Availability and Changes
We may add, change, suspend or discontinue any part of the Service at any time without notice. We do not promise that the Service will be available, uninterrupted or error-free, or that any particular information will continue to be published.
10. Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law, including your rights under the Consumer Rights Act 2015. Subject to that: (a) the Service and its content are provided "as is", and we make no warranty as to the accuracy, currency or completeness of any information on the Service; (b) we are not liable for any loss arising from your use of, or reliance on, the Service or its content, including decisions made on the basis of a listed price and any dealings you have with a venue; and (c) where our liability cannot be excluded but can be limited, it is limited to the greatest extent the law allows.
11. Privacy
Our handling of information in connection with the Service is described in the Privacy Policy, which forms part of these Terms.
12. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on this page, and the effective date above will be updated accordingly. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
13. Governing Law and Contact
These Terms are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales, and if you live in Scotland or Northern Ireland you may also bring proceedings in the courts there. Questions about these Terms may be directed to support@pubwatchuk.co.uk.
